Is the act of subjecting someone to the death penalty an ethnical and economic form of punishment or not?
Many studies have been conducted in hopes of answering the age old question on if sentencing people to capital punishment is ethical. The foundations of law are often said to be linked to those of religious beliefs. The term “In God We Trust” is often thrown around when debating on if a person should be sentenced to death is reasonable or not (Keane, 2008). Some people commit heinous crimes that a person would almost assume deserves the death penalty. Every state, however, has different rules and stipulations as to if a person can and will be given capital punishment (Keane, 2008). Premeditated murders and murders that involve rape, murders that involve multiple parties, and gruesome kidnappings or robberies that result in the death of people at the hands of another, are usually handled with capital punishment (Keane, 2008). Many times, a person is deemed mentally incapable of making the right decisions when they carry out a crime that can be punished by the death sentence. There is a rough average of 3,557 hours that attorneys spend on a death penalty case (Frances, 2014). Medical experts must also be factored in on capital punishment trials. An offender has the right to a medical examination to determine their mental capability. If the accused is deemed to be insane, then a different form of punishment is given to that person, in place of being sentenced to death. Death trials must also remain constitutional. Due to this, attorneys and legal professionals may have to change their initial approach when taking part in a capital punishment trial. The delay causes the prices on the trial to inflate. Jury trial selections for capital punishment cases are also more expensive than the average case. That alone, also raises the budget for a capital murder case. While an offender is awaiting, the determination of their sentence for a capital punishment trial, the cost of housing the individual is also something to take into account (Frances, 2014).
