The legislative and the judiciary are the Branches that take part in impeachment process. If the House of Representatives believe the president has committed an unlawful act then they can try him. Then the House of Representatives have majority vote on a formal vote it then goes to be approved by the House judiciary Committee. As long as there is enough evidence that the President took part in an unjustified act, articles is created. The branch that is being investigated is the Executive branch. The impeachment process has to do with the president if he is believed to have taken part in an unlawful act. To make sure the President can not get away with an unconstitutional act and not following the responsibilities they have as being the president of the United States of America. If the House of Representatives believe the President is committing acts that he should not be while in Presidency they can vote to have him tried and be taken out of office. For it to move onto the House of Judiciary Committee they need simple majority. “less than half of the total votes cast but more than the minimum required to win, as when there are more than two candidates or choices” (dictionary.com). If the House of Judiciary Committee believes there is enough evidence to cause an impeachment trial, then they will write an article. Stated in this article are the specific charges with the evidence to support the charges. Then the Committee votes on each article, if there is more than one article the House of Representatives must vote whether it should go to the Senate, again only needing simple majority. If the House approves of at least on article then the President it actually impeached, then the case moves to the Senate which then congress appoints managers/prosecutors. The President can choose anyone they want to representative them, they don’t have to come to the trial they can choose to have the his defense be handled by his chosen lawyers. The trial is held in a Senate with the Chief of Justice present, it is held in a court like manner. Including examination and cross-examination of the witness. The Senates stay quiet if they have any questions they are written down and given to the
