Torts are extremely important to know about in business, especially if one wants to be involved in owning a business or anything to do with a higher up rank. They are violations that are included in civil law. In which a person can be held liable for acting in no way of their own fault. Committing wrongs in tortious situations are stated as intentional, negligent, or strict liability torts. Torts are a civil action which involves private parties. Their punishments if need be, doesn't include a fine or incarceration. Their punishments usually involves restoring the injured party and paying their needs at the time of the incident. Sometimes a court order may force the tortfeasor to do something for the injured victim but usually that isn't needed.

Negligence is defined as the failure to use reasonable care to avoid a foreseeable harm to a person, place or thing(Samuelson, pg 77). One person can be liable if their failure to act upon a situation causes an injury. There are primarily five elements to be deemed negligent. They are as follows; (1) Defendant owed a duty of reasonable care; (2) Defendant did not behave in a reasonable manner to demonstrate care; (3) Plaintiff suffered an injury as a result of the defendant's actions or inactions; (4) The injury caused actual damages; (5) Proximate cause: defendant's actions or inactions were the cause of the injury
