Prior to discussing the Nature of constitutions whether codified or uncodified it is first useful to define exactly the purpose of a constitution and its effect on the functions of state and the relationship it governs between the public and government. Finer in his book the five constitutions defines a constitution as:
“Codes of rules which aspire to regulate the allocation of functions, powers and duties among various agencies and officers of government and define the relations ship between them and the Public”

The benefits of having a superior being of constitutional law can be seen above as in that the constitutional court is the defender of the constitution and acts as a protector in the sense that government cannot act outside of the constitution and abuse its powers easily as the statute can be
