A fundamental right is the protection of human rights from government encroachment. To simplify things, this means that the government is not allowed to violate basic human rights, such as abortion. There are several fundamental rights that include the right to abortion when closely evaluating them. For example, in 1973 the abortion case known as Roe v Wade decided that the right to privacy includes the right to abortion ("Pro & Con Arguments: "Should Abortion Be Legal?"). The Supreme Court began to recognize abortion as a fundamental right after this case. Along with the right to privacy, humans have sexual and reproductive rights. This incorporates the right on deciding whether or not to have children, and how many to have. It is ludicrous to think that sexual and reproductive rights do not include the right to abortion. This goes for rape victims, having an unhealthy baby, or simply women that may have health risks during pregnancy and/or birth. As a matter of fact, national public opinion polls began giving surveys asking people what conditions should allow women to have an abortion, and over 80% approved of abortions in cases involving the mother’s health, possible child deformity, and pregnancy due to rape (Hayley 314). Sometimes women face health risks when they are pregnant. In some cases, the mother is often at risk for dying. To bring a child into the world motherless is sad. What is even sadder is to refuse a woman the right to have an abortion in order to save her life or protect herself from developing certain health conditions. Along with health risks pertaining the mother, the baby is also sometimes unhealthy or possesses certain risks. It is not uncommon for women to get certain tests done during pregnancy to assure that their baby is developing normally and healthy. Unfortunately, perfectly healthy babies are not always the case. Abortion gives women the option to bring unhealthy babies into this world or not. Sometimes, scientifically speaking, it is considered more humane to abort a baby with health or developmental issues. For instance, if a child has a brain condition, such as anencephaly, that makes their life cut short to around three or four years
