Facts Linda Brown, an eight-year-old African American girl, was denied permission to attend an all white school only five blocks away from her home in Topeka, Kansas. Linda’s parents made the decision to file a lawsuit against the Board of Education of Topeka, alleging that they are depriving Linda of equal protection of laws as required under the Fourteenth Amendment. The courts denied that there were any violations of Linda Brown’s right because of the 1896 Plessy v. Ferguson decision, “separate but equal.” The Brown’s appealed their case to the United States Supreme Court.
