Those ideas being, the age a child reaches puberty and the age a child can give consent “the attainment of the pubertal age, which is connected to sexuality and pregnancy, and the attainment of the age of consent, which is connected to individual choice.”. (Francavilla) Both the U.S and India are in somewhat of agreement making the legal age eighteen, expect twenty-one in the case of men in India. The belief held in the U.S. pertaining to child marriage is that “child marriage is widely acknowledged to be harmful sociocultural practice that is both a cause and outcome of human rights violations.”. (Maswikwa) While child marriage is a norm in India, it is not acceptable in the U.S. In India when a girl is being married off at a young age, no one is thinking about the rights she has. The fact that she is young should be more of reason a society, whether it be the U.S or India to protect these rights. The U.S makes it clear that “child marriage also permits sexual exploitation”. The harsh reality in India is that nothing has been down, child abusers have been getting away with this heinous crime. The reason for this is “Historically, child sexual abuse (CSA) has been a hidden problem in India, largely ignored in public discourse and by the criminal justice system” (Jyoti). Child abuse being ignored is not in easy fact too sallow but unfortunately the people of India have no choice. As mentioned previously there many forms of child abuse, in India they only considered case that involved rape “rape was the main, if not the only, specific offence against children recognized by law in India” (Jyoti). Other forms of child sexual abuse include, “child sexual assault, harassment, and exploitation for pornography”. (Jyoti) None of which were recognized in the laws and policies India has for child sexual abuse. Studies show that almost half of the children experienced child abuse “53% reputedly experienced some form of sexual abuse” (Jyoti). A country with over 50% percent of its children facing child abuses, should have laws in polices in place to lower this statistic and protect these children from the predators in their
