    community. In 1985, Steven was arrested in his home at about 11:50 at night, charged with rape an assault against someone named Penny Bernsteen. Penny was attacked on a beach nearby her house where she was going on a run. A man she’s never seen before attacked and sexually assaulted her. When she went to the police station and gave a description, Judy Dvorak instantly said “Oh that sounds an awful lot like Steven Avery” and from there this case was centered on Avery. The police only showed picture of Avery, and the drawing of the witness’s description, was just a drawing of an older photo the police had of Avery back from 1982. With the drawing and the witness’s statement as their only evidence, the police fled to Avery’s house to make an arrest. That night, the same day of the attack, Steven was arrested at 11:50 PM. Even with many witnesses, including a store clerk, proving that Steven was nowhere near the crime scene at the time of the crime, he was sent to prison anyway. Steven was in prison for 18 years for a crime that he has never committed. During the duration of his time in jail, the innocence project decided to pick up Steven Avery’s case, claiming there was no DNA evidence that placed him at the crime scene. The innocent project resurfaced this case and used their newer technology with DNA, finding that from the skin under Penny Bernsteen’s nails, were holding a deferent allele than Avery and Bernsteen, who shared this same.
