As soon as he was cautioned, warned, read his rights, and arrested, he began to be extremely upset. Smith and I went to the station right away to get a breath sample as soon as the paper work was done. Firstly, Smith took his cuffs off and patted him down, placing the driver’s possessions on the counter at the booking-in station. Smith handed the driver his phone and told him to turn it off and give it back to him, but the driver did not want to give back the phone. It took quite a bit of arguing to get the phone back and to get him into the phone booth to call for some legal counsel. The driver did not want to cooperate and it was a big struggle to get a proper breath sample after that (Took 5 tries to get two samples that were the legal 15 minutes apart). At the end of it, the driver blew more than twice the legal limit and went to a cell. Smith and the other officers kept their composure and did not give the driver any counsel except for how to access it. I expected them to act like professionals and that is what they
