CONFIDENTIAL (or fiduciary) relationship exists. The burden of proving undue influence ordinarily is upon the will contestant. However, a presumption of undue influence arises when a confidential relationship existed between the testator and the party who allegedly unduly influenced him when that party had any involvement in drafting the will, and influence affected testamentary disposition. In NY, the surrogate's court must review a bequest to an attorney who drafted the will, even if no one requests it. This is called "Putnam scrutiny" and is an assessment of the relationship between the testator and attorney, the nature and size of the bequest, and the other provisions in current and prior wills. A testator who intends to leave a bequest to an attorney should use independent counsel to draft the will.
